The company Tostini S.r.l. is nicknamed hereinafter “SELLER”

The sales prices indicated are expressed in euros including VAT, without taking into account shipping costs. The latter are free in Italy with an expense equal to or greater than € 20. For a cost of less than € 20 the cost of shipping, in Italy, is always € 6. Abroad the costs vary according to the country of destination and the weight of the shipment. For shipments to the countries of the European Community the cost of shipping starts from € 7.50. For shipments to countries outside the European Community shipping costs start from € 25.00. The “SELLER” reserves the right to change prices without notice and to change shipping prices at its discretion, but undertakes to apply the prices in force and to explicitly display prices and shipping costs, as indicated on the site, at the time of the order. Any refunds are always made by Tostini S.r.l. through the payment system used to make the purchase, by PayPal, Credit Card, bank transfer. Conditions subject to Legislative Decree 206/2005

Shipping Times

Delivery times vary depending on the payment method chosen by the same. The delivery of the products takes place within 24/48 working hours from the completion of the order or within 24/48 hours from the bank credit, if you choose the bank transfer as a payment method. The shipping time process is as follows:

A) Day 0 – receipt of the order

the back office processes orders received by 12 am; otherwise they are processed the following day. The same goes for orders received on Saturdays, Sundays or public holidays: they will be processed on the first working day following that of the order itself. The order is processed depending on the payment method chosen, and in particular:

– if the payment method chosen is CREDIT CARD, AMAZON PAY or PayPal the order will be processed on the same day;

– if the payment method chosen is BANK TRANSFER, the order will be processed when the credit will be displayed on the bank account of the Company Tostini S.r.l.

B) Day 1 – Courier Freight Forwarder

If the order is received by 12 am, the Courier Forwarder collects the goods by 18.00 at our warehouses. The courier will be given the Accompanying Invoice containing the destination location and any notes included in the order. At the same time as the collection of the product, an e-mail will be sent to the customer containing the Shipping Number; this will allow the customer to follow in real time on the courier’s website the delivery status and estimated times.

C) Day 2 – Delivery of goods

The product will be delivered to the address indicated at the time of order confirmation.

Delivery Methods

Standard Delivery: delivery takes place within 1/2 working days from the date of entrustment to the Courier.

In detail: we deliver in a maximum of 48 hours from when we entrust the goods to the courier. For all of Italy, including the cost of shipping is indicated at the time of the order. In addition, the timing described above for the Islands may vary according to unpredictable elements: for example, adverse weather conditions etc.

The Invoice

The Invoice must be requested during the order and is inserted at the time of shipment inside a transparent envelope that is applied to the outside of the package. The customer can, however, request a copy by sending an email to support@tostini.com. The Invoice, representing the valid document for the warranty on the product, must be kept with care. The invoice of the purchased good is issued by the “SELLER”..

Refunds

Customers will have as their sole contact person for any complaint or for any related problem both in the order phase and in the after-sales phase the company Tostini S.r.l., the same is equipped with all the tools to manage problems also through The Call Center. Any refunds are made by Tostini S.r.l. through the payment system used to make the purchase, by PayPal, Credit Card, bank transfer. The Refund will be made no later than 10 working days after the return of the goods.

Order Fulfillment

Upon delivery of the goods, the Customer is required to check:

– that the number of packages delivered corresponds to what is indicated in the transport document

– that the packaging is intact and not altered even in the closing tapes

In case of tampering and / or breakage, the Customer must immediately contest the shipment and / or delivery by affixing the words “RESERVE FOR DAMAGED PACKAGING” on the copy of the delivery document to be returned signed to the courier or other operator.

The Customer is required to report any damage within 7 (seven) days of receipt of the goods, by registered mail in advance or by e-mail to the following e-mail address: support@tostini.com

For each order the Customer is required to specify at least one telephone number to allow the express courier to contact him in case of difficulty in delivery; if the delivery is not successful for reasons not attributable to Tostini S.r.l., or to the express courier for more than 5 consecutive days, the order will be considered canceled and the Customer will be charged the custody costs as quantified by the express courier.

Right of Withdrawal

“SELLER” recognizes the right of withdrawal:

Pursuant to D.Lgs. 206/2005, if the customer is a consumer (ie a natural person who purchases the goods for purposes not related to his professional activity, or does not make the purchase by indicating in the order form to Tostini S.r.l a reference of VAT number), he has the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty. The product must be returned in compliance with the resaleability (intact, never put into operation and complete with the original packaging and all the original accessories of the product).

The Customer is required to notify you within 14 working days from the date of delivery of the goods, by e-mail or registered mail to the e-mail address: support@tostini.com

Upon receipt of the registered letter we will provide the exact address of return of the product.

Goods returned without authorization will be automatically rejected.

For the correct recognition of the right of withdrawal, we specify that:

– The product must be returned by the Customer in its original packaging, complete in all its parts (including packaging and any documentation and accessory equipment, intact consumables, manuals, cables, etc …); to limit damage to the original packaging, we recommend, when possible, to put it in a second box; in all cases, the affixing of labels or adhesive tapes directly on the original packaging of the product must be avoided

– The product must be returned in the times and in the manner described above to the address that will be reported by Tostini S.r.l

– The costs of return are always borne by the Customer

Applicable Law

The sales contract between the Customer and “SELLER” is concluded in Italy and governed by Italian law. For the solution of civil and criminal disputes arising from the conclusion of this distance sales contract, the territorial jurisdiction is exclusively that of the Court of Teggiano.

Contract of sale

“SELLER” accepts orders with delivery to be made exclusively in the Italian territory.

“SELLER” will issue an invoice, attaching it to the product intended for delivery

“SELLER” inserts in the invoice indicated above only the data provided by the customer, specifying that no change will be allowed after the issuance of the invoice itself.

The customer can only purchase the products, as per the electronic catalog on the site www.tostini.com existing at the time the order is sent. Tostini S.r.l., in this regard, informs that the images and technical data, none excluded and / or excepted, accompanying the product sheet displayed must not be considered by the customer complete and exhaustive of the characteristics but may, therefore, be different in size, color and accessories or other.

For all that has been communicated and accepted by the customer so far, no responsibility can be attributed, for various reasons and / or reasons, to Tostini S.r.l..

The correct receipt of the order is confirmed by Tostini S.r.l. by email response, sent exclusively to the e-mail address communicated by the customer. This confirmation message will re-propose all the data entered by the customer who undertakes to verify its correctness and to communicate, no later than 2 days later, any correction. Only then will Tostini S.r.l., having verified the actual availability of the goods as well as the accuracy of the customer data, send by e-mail the definitive acceptance of the contract, which only from this moment must be considered concluded and stipulated between the parties for all legal purposes.

By placing the order on the site www.tostini.com the customer declares to have read, the conditions of sale, the payment methods proposed as well as the entire purchase procedure and also declares to accept them without any reservation and to have received exhaustive information in this regard. Furthermore, with express reference to Articles. 3 and 4 of Legislative Decree 185/89 the customer will receive, by e-mail, all the information necessary for the identification of the seller that the customer is required, at his expense, to keep together with the e-mail of acceptance of the contract.

In the event that the customer should return, for legitimate reasons, the products purchased, he must provide for the shipment within the established terms and exclusively at the registered office of Tostini S.r.l..
